An effective privatization contract should include a clear description of the contractor's responsibilities and requirements; how the work will be accomplished, compensated, and monitored; and what penalties will be incurred if performance is substandard. However, in most cases, privatization contracts include loopholes that allow companies to change their practices in any way they deem necessary, or hazy language that makes it difficult for jurisdictions to enforce the terms of the contract. In some cases, Penalties for noncompliance are set so low that it is more profitable for the company to ignore the terms of the contract and simply pay the fines.
