Describe the jury selection process. Why is it often considered the most important step in a criminal trial?
What will be an ideal response?
The first step in selecting an impartial jury is to create a random list of names of people who are eligible to serve on a jury. This list of potential jurors is called the jury panel. Once a list of potential jurors is compiled, the court clerk or court administrator randomly chooses names of people who can serve on a jury. The court then uses the list to choose the final jury. The potential jurors may be asked in open court about their background, family status, profession, or any other factor that the attorneys believe may predict their ability to serve as well as how they may judge the defendant. The attorneys try to determine if a potential juror has a bias or prejudice toward the defendant and to eliminate all members who might have a reason not to render an impartial decision. When the questioning is done, the attorneys can then select jurors who are they feel are acceptable.
