What are the required elements for the formation of a contract?

To form a contract, the following elements must be present: 1 . mutual consent; 2 . consideration; 3 . capable parties; and 4 . legal subject matter. Mutual consider means that both parties must agree to the same terms. Consideration is a promise made under a contract by each party to give something of value to the other party. Parties must have sufficient capacity and the contract must have a legal subject matter.
