Who has the right to access psychotherapy notes?

Psychotherapy notes are considered a work product privilege and are immune from subpoena. They may be disposed of at any time, unless state law provides otherwise. They are required to be kept separate from an individual’s medical record as required under HIPAA. Further, patients do not have the right of access to psychotherapy notes. Health plan providers may not condition payment upon release of psychotherapy notes.
