The feminist movement in the 1970's argued all forced sex should be illegal and criminalized. Marital rape was officially recognized in 1975, when South Dakota rewrote its rape laws to include husbands. It took until 1993 for all states to have followed suit. Nonetheless, there are approximately 30 states that provide the marital relationship as a mitigating factor in sentencing. Raped males were assumed to be a rare victim. The concept of a man raping another male conjures many cultural taboos and myths. Congress revised the federal rape statutes as gender neutral, meaning both the offender and the victim could be male or female. Males have a three percent lifetime prevalence of being sexually assaulted, and it is most likely to occur before they reach the age of 18 . Yet, most statistics will be inaccurate as most men do not report, statistics do not include sexual assaults occurring in institutional settings such a mental hospitals and prisons.
