The employees were in compliance with the law because under the statutes that existed at that time, until the party is actually served with a request for the documents, there is no obstruction of justice in their destruction. However, the case indicates that those at Andersen were aware that there would be an investigation, with or without the documents. The employees may have been in technical compliance with the law, but they were not acting in good faith and were ignoring the spirit of the law. Also, they were not seeing the issue from the perspective of the long term. What were the intentions in their actions? What were the likely consequences of their actions? How would their actions be reported on the front page of the newspaper?
