Because the practice of law is a monopoly, nonlawyers who want to have an expanded role in
providing legal services to the public have almost no way to make any inroads, other than to
become lawyers and advocate change within the legal system. The bar fights the
unauthorized practice of law as a crusade against those who would defraud the public and
take advantage of those who are susceptible to legal charlatans. The state supreme courts,
who have the authority to determine what is and is not the unauthorized practice of law, very
often cast their opinions in terms of protecting the consumer of legal services against
unscrupulous or incapable service providers. And even in cases where federal and/or state
laws allow for nonlawyer representation in administrative agencies, courts have occasionally
agreed with bar associations, or protesting lawyers, in finding certain types of agency
representation to be the unauthorized practice of law. But, there is another view, which is that
the legal monopoly keeps its market share by accusing nonlawyers of the unauthorized
practice of law, not because the nonlawyers are incapable, or the customers ignorant, but
because the legal service providers are taking away business from the legal profession. As
was evidenced in the story in the chapter on NOLO being sued for selling self-help legal
books, the argument could be made that the public is being harmed, rather than helped, by
the attempts of bar associations to go after nonlawyer legal service providers who do not hold
themselves out as lawyers and who serve their customers/clients adequately.
