The purpose of discovery is to obtain relevant information from an opposing party or witness prior to trial. Interrogatories are a type of discovery that allows each party to ask the other a set of questions to be answered under oath in writing. Some jurisdictions limit the number of questions and answers must be made within a prescribed time. A deposition consists of an oral examination of a party or witness, under oath, before a certified court stenographer who administers the oath to the deponent. A request for admissions is available only between parties. One party submits a written request to the other to admit to the genuineness of either the facts or documents. If the party fails to respond timely, then the facts or documents are deemed admitted. A Request for Production allows a party to inspect or copy documents that are material to the issues of the case. The moving party bears the costs of copying the items. A party may request permission to gain access to the other party's property to survey, inspect, test or photograph. A plaintiff seeking coverage for injuries can be compelled to undergo a physical or medical exam upon the defendant’s request. If a party fails to comply with a discovery request, the court may impose sanctions.
