One of the legal issues inherent in the fight against terrorism discussed in the text is whether
the military has the power to indefinitely detain persons suspected of terrorism even if they
are American citizens. American citizens have the right to due process under the
Constitution. Detaining an American indefinitely violates due process. The right to habeas
corpus, another Constitutional right, is also violated by this indefinite detention. The Court
has held in Hamdi v. Rumsfeld that due process requires that a U.S. citizen who is detained
for allegedly fighting against the United States in Afghanistan as an enemy combatant
should be given a meaningful opportunity to contest the factual basis for his detention
before a neutral decision maker.
