The First Amendment to the Constitution established the principle of separation of church and state. This principle relates to issues that remain today, such as whether prayer should be allowed in schools and whether private, religious schools should be supported with public tax dollars.
The 10th Amendment explicitly removed the federal government from a central role in operating schools and gave it to the states. As a result, all states have departments of education which are responsible for the schools in their states. For example, teachers are licensed by states instead of the federal government, and states—not the federal government—establish the curriculum for their schools.
