There are three problems with retribution. First, it is difficult to translate abstract justice into specific penalties. What are a rapist's just deserts? Is castration justice? How many years in prison is a robbery worth? How much suffering by the offender will repay the pain of a disfigured assault victim? Critics of retribution answer, "We can't achieve just retribution! And we shouldn't even try.". Why not? The answer lies in a second problem: Retributionists cannot prove that human nature craves revenge. Third, and probably the strongest argument against retribution, is that most criminal laws are not based on moral blameworthiness because they do not require criminal intent.
