The moment a petition in bankruptcy-either voluntary or involuntary-is filed, there exists an automatic stay, or suspension, of nearly all litigation and other action by creditors against the debtor or the debtor's property. In other words, once a petition has been filed, creditors cannot contact the debtor by phone or mail or start any legal proceedings to recover debts or to repossess property.In some circumstances, a creditor may petition the bankruptcy court for relief from the automatic stay, however. The Code provides that if a creditor knowingly violates the automatic stay (a willful violation), any party injured, including the debtor, is entitled to recover actual damages, costs, and attorneys' fees and may be entitled to recover punitive damages as well.
