In criminal law, there is substantive criminal law that defines crimes and their punishment. It involves issues like the mental and physical elements of a crime, crime categories, and criminal defenses. Criminal law also concerns procedural criminal law, which sets out the basic rules of practice in the criminal justice system. Elements of criminal procedure include the law of arrest, the law of search and seizure, questions of appeal, jury selection, and the right to counsel. On the other hand, civil law consists of a set of rules governing relations between private parties, including both individuals and organizations. This type of law resolves, controls, and shapes interactions like contracts, wills and trusts, property ownership, and commerce. A tort is a personal injury brought forward in civil cases. These two branches of law do overlap. In the case of a burglary, the offender can be charged with a criminal offense of theft and the victim can also seek civil damages even if the offender is not found guilty of a crime.
