The biggest legal considerations in the selection process are the measures that are required to ensure that we avoid illegal employment discrimination. There are also two laws that deal specifically with the ability to apply certain types of testing to employment candidates: the Employee Polygraph Protection Act of 1988 (EPPA) and the Genetic Testing Nondiscrimination Act of 2008 (GINA). The EPPA limits the use of polygraphs in normal businesses to generally two instances: when the employee will be involved in company security operations and when the employee will have access to federally identified controlled substances. GINA protects prospective employees from discrimination by health insurers and employers on the basis of their DNA information.
