Air rights are the rights in the air above the land. They represent the right to erect a structure to a particular height. Air space has its limits which are determined by technological advancement. Mineral rights or subsurface rights are the rights to take any of the minerals found in the earth's crust. Air rights can be severed by granting a license for the use of air space by someone else. Mineral rights can be severed through sale, lease, or transfer to another.
