If Congress is not clear on a subject within an agency's jurisdiction, the agency's decision is to be respected by a reviewing court unless that decision is unreasonable. Agencies exercise discretion to decide who shall be prosecuted. Agencies also have discretion for establishing policies to govern the processing of claims and applications.
