One criterion is a contract bar. If a current labor contract is controlling and is valid, then this contract may contain a provision that prohibits any consideration for a change in status. Another criterion for evaluating the timeliness of a request for changes in affiliation is a certification bar. A certification bar is defined by state legislation and affords an elected union the opportunity to represent employees without any challenges during a specified period of time. Certification bars are controlling generally for the immediate two years following initial certification of a union. Still another criterion for evaluating the timeliness of a request for changes in affiliation is an election bar. An election bar exists only by state statute, and if present, will be found as part of the public sector bargaining law. Usually an election bar prohibits any consideration for change in the status quo if a valid election has been held in the last two years.
