Briefly discuss enforcement of a judgment


Enforcement faces the winning party if the losing party does not voluntarily pay the judgment and there is no appeal or the reviewing court affirms the judgment. The winning party must request the clerk to issue a writ of execution demanding payment of the judgment. This writ is served by the sheriff. If the writ is returned "unsatisfied" the winning party may post bond and order a levy on and sale of specific nonexempt property of the losing party. An alternative is garnishment, under which the losing party's employer or bank can be contacted so that the judgment can be collected from the losing party's wages or a bank account.
