The Fair Labor Standards Act (FLSA) provides minimum pay and overtime provisions for both public and private sector employees, and has special provisions for public safety officers. State and local police employees were covered by the FLSA as a result of the 1985 U.S. Supreme Court case Garcia v. San Antonio Transit Authority.
For police officers, the FLSA becomes involved when overtime salaries must be paid, a common occurrence in policing. The FLSA states that an employer must generally pay employees time and a half for all hours worked over 40 per week, as well as to personnel for all work in excess of 43 hours in a 7-day cycle or 171 hours in a 28 day period. Officers may accrue a maximum of 480 hours of “comp” time which, if not used as leave, must be paid off upon separation from employment. Employers generally cannot require employees to take comp time in lieu of cash.
