Why is it that a lineup should consist of several individuals while a show-up consisting of one suspect can be considered constitutional?
What will be an ideal response?
Answer: Answers should explain the due process and Sixth Amendment requirements of lineups and the ways to reduce suggestibility in them. Students should then explain that even though lineups are better at avoiding false identifications, show-ups are permissible in limited circumstances immediately following a crime and if there is a need or desire to have an immediate identification (or exoneration).
