Certain activities are considered non-billable, regardless of how much time it takes to
perform them. If a paralegal/legal assistant performs non-billable activities, the result is the
same—the client should not be billed for those activities. Non-billable activities are the types
of things that might be thought of as pure “housekeeping” duties at the firm.
Some courts have concluded that proofreading internal documents is a non-billable activity,
as would be billing the client for postage charges and document reproduction. The reason
why Courts or ethics opinions consider certain activities or items to be non-billable is that
those types of overhead costs are recouped through the lawyer’s fee.
