What rationale is provided for allowing police officers to base a finding of probable cause on hearsay? What dangers could you see in allowing hearsay as a basis for establishing probable cause?
What will be an ideal response?
Student responses should include that officers don’t always have the luxury of deciding whether or not to rely on hearsay—they must react quickly to reports of crime and might jeopardize the safety of others if they delay their response. To address the issue, the Court follows several rules about the sources of the hearsay and the ability of officers to rely on information from those sources to establish probable cause—the citizen-informant, the police officer, and police informants. The problems with hearsay: are that it is difficult to determine if secondhand information is truthful and accurate.
