Due process is a restraint on the power of government, allowing a person to be deprived of life, liberty, or property only by a process that is fair and ensures justification for the action, guaranteed by the Fifth and Fourteenth Amendments. Examples include rights to trial by jury, attorney representation, and protection against self-incrimination. Also substantive due process prohibits vague, overbroad, arbitrary laws that fail to give proper notice. (III. H.)
