Explain the search and seizure rules which apply to abandoned property
What will be an ideal response?
Abandoned property is property that no longer belongs to anyone. This property is no longer covered by anyone's reasonable expectation of privacy; therefore it can be seized without a search warrant. The main restriction is on the officer's ability to go where it is located in order to pick it up.
Another issue related to abandoned property is how do you tell that it is abandoned? Items in a trash can sitting on the curb awaiting the garbage collector are abandoned. If the same garbage can were on private property, it might be there for another purpose. For example, it might be a storage bin; if so, its contents would not be abandoned. A garbage can left on the loading dock may be awaiting pick up by its new owner. It is always necessary to put the facts in context to determine whether the rule regarding abandoned property applies.
