It comes from Civil Procedure Rule 26(B) and allows a lawyer to refuse to provide
information during litigation that would otherwise be discoverable, except for the fact that it
is protected as client information gained in the course of the representation. Under the “work
product” rule, certain types of protected information can be obtained, according to a twopart
test. And, under the “attorney-opinion work product rule,” there is an absolute protection
of the information that concerns the lawyer’s mental impressions, strategies, and theories
about the litigation.
