Could John Adams represent the Boston Massacre defendants if the Model Rules of Professional Conduct were in effect then?
What will be an ideal response?
I think he could have represented them. The kind of conflict that would have applied would
have been a conflict between the lawyer’s own interests (freedom from the Crown) and the
client’s interests (being found not guilty for killing others seeking freedom from the Crown).
Such a conflict can be overcome by Adams making his clients aware of the conflict and then
seeking their consent to his continued representation of them.
