Administrative proceedings are heard by a hearing officer, who may be an
administrative law judge, referee, commissioner, or other person authorized by the agency.
Hearing officers may or may not be attorneys. Administrative jurisdiction is limited to the
particular agency’s powers and regulations. Appeals of administrative decisions proceed
directly to the U.S. Court of Appeals.
Judicial proceedings are conducted by a judge, who is usually an attorney. Judicial
proceedings cover general jurisdiction matters. Appeals usually follow the hierarchy of
appellate courts (trial court, intermediate appellate court, supreme court).
