Describe the Model Penal Code's position on Theft of Services
What will be an ideal response?
• A person is guilty of theft if he obtains services without paying, when payment is expected.
• Services includes, labor, professional service, transportation, telephone, or other public service, accommodation in hotels, restaurants or elsewhere, admission to exhibitions, and the use of vehicles or other moveable property.
• Where payment is expected immediately upon providing the service and the person absconds without paying, a presumption arises that the service was obtained by deception as to the intent to pay.
• If a person is control over the disposition of services of others and converts the benefit of those services to his/her own use, theft has occurred.
