Why are special defenses rarely asserted in divorce proceedings?

Two of the most common affirmative defenses are that the statute of limitations has run and that there is already a binding settlement. Since the action commences at any time the plaintiff chooses to file, the first isn’t likely. The second defense may be true (a binding settlement agreement may exist), but the divorce isn’t final until the court decrees it. Most of the time, a divorce is anticipated by the responding party, and there will be no defenses other than denials of specific allegations. A claim can still be made based upon improper service, or the lack of a valid marriage.
