What is a "Markman hearing"?
What will be an ideal response?
A Markman hearing is one held outside the presence of a jury to construe the claims in a patent. Although juries determine if infringement has occurred, construing claims in a patent is a question of law for the judge. Markman hearings thus determine the scope of a patent's claims and are conducted by judges-not juries.
