A female employee in the department you manage asserts that she is being sexually harassed by a coworker. How would you determine whether the treatment she receives qualifies as sexual harassment?
What will be an ideal response?
First, know that you may require the help of an HR department to determine the
nature of the sexual harassment, if it has occurred, but that no matter what the
description of the harassment is that the employee gives, it should be taken very
seriously. There are generally two different classes of sexual harassment--quid-pro-quo and hostile work environment--and it is possible for a pattern of incidents to satisfy both requirements. In a quid-pro-quo situation, a sexual favor is asked or demanded in exchange for preferred work treatment or promotion. Hostile work environment is any sexual harassment that results in a hostile work environment. Even rude comments about a person’s gender can qualify, and texting of a certain nature can also qualify as harassment.
